OCCUPATIONAL SAFETY CONSULTING

This sector requires a strong specialization and today more than 5,000 companies rely on our Group and on the specialists we employ to deal in a simple and reasonable way with the required adaptations to changing occupational safety requirements and with retaining compliance to the law requirements in this area. But when do the consultancy and training services required for occupational safety become necessary? Easy: whenever a business, either public or private, employs employees or subject the law equates to employees.

Employer

The holder of the employment relationship with the employee*, or a similar legal or natural person to which, depending on the nature and structure of the organisation the employee* actually works in, has the responsibility of the organisation or of the production unit in that he/she has decision making and expenditure powers. In the Public Administration as defined by article 1, paragraph 2 of legislative decree no. 165 of March 30, 2001 the employer is the manager entrusted with equal management autonomy or the manager having similar powers and autonomy, he is defined by the top management of each individual department taking into account the location and the scope of the powers of the offices in which the activity in re is carried out with autonomous decision-making and spending powers. In case the employer is not defined or the defined employer does not fit with the above criteria, the employer is the top management body.

Employee

The person who, regardless of the type of contract, performs a working activity as part of the scope of an organisation run by a public or private employer, for free or for a pay, or even for the sole purpose of learning a trade, an art or a profession, (domestic workers or home care workers). The employees as defined above are regarded as equal to: the worker/partner of a cooperative or of a partnership, even a de-facto one, that provides his/her work on behalf of the company and the institution itself; the associate with an interest ("associato in partecipazione") pursuant to article 2549 and following of the civil code; the participant to training and orientation programmes initiatives promoted as part of the education/work alternation and/or to facilitate future career choices by allowing youngster to know firsthand the labour market; university students and students in other learning institutions, as well as students of vocational training courses requiring use of and access to laboratories, machines, working equipment and tools of various types as well as use of chemicals, physical and biological agents, including computer displays and similar displays, only for the time where the student is actually using the instruments or laboratories; the volunteer, as defined by the law no. 266 of August 1, 1991; the volunteers of the National Fire Fighters Corp and Civil Protection; the volunteer serving in the volunteer civil service as per the Italian laws; the worker referred to in the legislative decree no. 468 of December 1, 1997 and the legislative decree of February 28, 2000 and the Legislative Decree no. 81/2008. The coordinated and continuous collaborators (CO.CO.CO.), as described in article 409, no. 3, of the code of civil procedure, as well as the project workers (CO.CO.PRO.) as per articles 61 and following of the legislative decree no. 276 of September 10, 2003 as amended, wherever their work is to be carried out exclusively in favour of the client, at the headquarters of the latter and with the use of improper working tools; Workers who are employed by way of temporary work contracts are also treated as employees.
